To the question of subjective party of the formal elements of criminal pollution of waters

Abstract

The article deals with the subjective side of criminal pollution of waters (Art. 250 of the Criminal Code). Currently, the literature and the practice of the Criminal Code there is no common understanding of mental attitude of the perpetrator to the committed crimes. This situation distorts the proper application of the article providing responsibility for the water pollution. On the basis of the scientists’s opinions and the judicial practice the author concludes about the subjective side of the criminal pollution of waters.
