The competition of legal norms in regulation of the control and supervisory activity.

Abstract

In the article a problem of legal norms’ competition of the Federal Act №294 «Defense of corporate bodies and entrepreneurs’ rights during the exercise of actions on the state control (supervisory) and municipal control» and The Code of the Russian Federation «About Administrative Offences» is formalized. It was shown a meaning of the competition of legal norms as a definite coincidence of different norms of these shown standard legal acts regulating grounds and the reasons for sudden inspection and administrative investigation during the actions of the state control and supervisory. The analyzed problem causes an alternative of the legal norms and choice of one of them depending on an executor of the law’s discretion. The ways of solutions of the legal norms’ competition by a legislative distribution of cases of actions involved with sudden inspection when there are reasons for an administrative investigation were proposed.
