The history of the Institute of “organized crime” development is observed in the article. Taking into account that there is no coverage of the historical aspect of this question in scientific literature, the studying of history of the Russian legislation regarding the responsibility for creation of criminal community (the criminal organization) becomes more actually.

The theoretical aspects of looking for the logic in taking decisions in the criminal procedure are presented in the article. There are attempts to understanding the principal of justice in accordance with the rights and legal interests of citizens. The author analyzes the verdicts of prosecutor in the modern criminal procedure and its classification under different grounds.
